PROCEDURES FOR IMPORTING STEEL TO VIETNAM

Steel is an alloy formed mainly from two main components: Iron (Fe), Carbon (C) and some other elemental components.

The demand for steel in the construction and manufacturing industries is increasing day by day. When the domestic supply capacity is not really guaranteed, the problem of sourcing from abroad is necessary. Vietnam mainly imports Steel from: China, Japan, Korea, Malaysia.

Imported steel types: coil, rod, tube, plate.

In order to properly determine import policies and procedures, it is necessary to first determine the HS code of the item.

TAX ON STEEL IMPORTS

For imported steel, in addition to import tax and VAT, businesses also have to pay additional safeguard tax and anti-dumping tax.

+ For raw steel: Including import tax, VAT.
+ For finished steel products: Including import tax, VAT and additional safeguard tax or anti-dumping tax.
Regulations on safeguard tax and anti-dumping tax on steel products

Self-defense tax according to the provisions of Decision 2968/QD-BCT and amendments according to Decision No: 538/QD-BCT, Official Letter 10704/BCT-QLCT and 1099/BCT-QLCT for billet and steel long import.
Anti-dumping tax under the provisions of 1656/QD-BCT dated April 29, 2016 of the Ministry of Industry and Trade for a number of cold rolled stainless steel products in coils or sheets imported from China, Malaysia, Indonesia, Taiwan.
Anti-dumping tax on imported galvanized steel products according to the provisions of Decision No. 1105/QD-BCT dated March 30, 2017 of the Ministry of Industry and Trade.
Temporary anti-dumping tax on some H-shaped steel products originating from China according to Decision No. 957/QD-BCT dated March 21, 2017 of the Ministry of Industry and Trade.

REGULATIONS ON IMPORT

Procedures for importing this type of goods are currently under the management of the Ministry of Science and Technology and are governed by a series of different documents, for example:
Joint Circular No. 58/2015/TTLT-BCT-BKHCN (hereinafter referred to as Circular 58) and Circular No. 18/2017/TT-BCT on publication of applicable standards; “Regulations on quality control of domestically produced and imported steel.”

Based on these regulations, the procedure for importing steel will include 4 main groups of work as follows:

Announcement of standards applicable to imported steel products.
Announcement of conformity for imported steel products.
State inspection of imported steel quality.
Customs clearance

SUPPLY DOCUMENTS FOR QUALITY TEST REGISTRATION

According to Official Dispatch No. 945/TC-QL dated October 11, 2017 of the Sub-Department of Standards, Metrology and Quality, procedures for quality inspection of imported steel products are now carried out in accordance with the provisions of Circular No. 27. /2012/TT-BKHCN and 07/2017/TT-BKHCN amending and supplementing a number of articles of Circular No. 27/2012/TT-BKHCN, the quality inspection of imported steel products has been transferred to post-mortem. Post-clearance checks

Specifically, according to the amended article 5a, the procedure for quality inspection of imported steel (except steel for concrete reinforcement) is carried out according to the provisions of Clause 1, Article 5 of the revised Circular No. 27/2012/TT-BKHCN , that is, the quality inspection results will be based on the self-assessment results of the importer, unless there is any doubt about the quality of imported steel, it will comply with Clause 2, Article 5, Amendment of this circular. , i.e. the Quality Check results will be based on the audit results of the certification body, registered or accredited inspection body.

To register for quality inspection, businesses can register through the National 1-stop portal at website: https://vnsw.gov.vn/. Or register directly at the Sub-Department of Standards, Metrology and Quality.

Dossier of registration for quality inspection include documents:

Paper “Registration for state inspection of imported goods’ quality” (04 copies, according to Form 1. DKKT – Appendix attached to Circular 27/2012/TT-BKHCN). It clearly states that the importer self-assess the conformity and commits that the quality of products and goods conforms to national technical regulations and announced applicable standards.
Announcement of conformity of imported steel products.
Copy of contract (Contract), list of goods (Packing list) (if any).
Copy (certified by the importer) bill of lading (Bill of Lading); invoice (Invoice); certificate of origin (C/O-Certificate of Origin) (if any).
Declaration of imported goods
Quality certificate of the exporting country (quality certificate, test results) (if any);
Sample photos of goods submitted to the regulation conformity certification agency or description of goods;
Samples of imported goods labels already affixed with the regulation conformity mark and auxiliary labels (if the main label does not have enough content as prescribed).
CFS certificate of free sale (if any).

Register for quality inspection of imported goods with the Sub-Department of Standards, Metrology and Quality. Within 1 working day, you will receive a copy of the quality inspection registration certificate with the registration confirmation from the General Department of Quality Measurement and submit it to the Customs office for customs clearance.

CUSTOMS – COMPLETE STEEL IMPORT PROCEDURE

When doing import customs procedures, you do not need to submit to the customs office the “Notice of quality inspection results of imported goods” issued by the Sub-Department of Standards, Metrology and Quality under the Ministry of Science and Technology,

Also, there is no need to submit the “Imported Steel Manifest” certified by the Heavy Industry Department under the Ministry of Industry and Trade and a copy of the “Certificate of Steel Import Demand” from the Department of Industry and Trade for customs clearance.

SET OF DOCUMENTS SUPPLY TO CUSTOMS INCLUDES:

The original paper “Registration for state inspection of imported goods quality” certified by the General Department of Quality Measurement.
Copy of Declaration of Conformity of imported steel products.
Other relevant documents as prescribed: Import customs declaration, Contract (Sales contract), Commercial invoice (Commercial invoice), List of goods (Packing list), Bill of Lading (Bill of Lading) , Certificate of Origin (Certificate of Origin).
After you have enough customs documents and goods quality inspection registration, you proceed to submit the customs declaration to the customs office.

Then, they will receive, process and stream declarations according to the process. Depending on the results of the declaration, it is Green Stream, Yellow Stream, or Red Stream

Then you present the above documents to the customs office that the shipment can be cleared.

ANNOUNCEMENT OF STANDARDS FOR IMPORTED STEEL

To import a new steel product, you must make a declaration of applicable standards as prescribed in Circular 58, specifically under Article 3: “Announcing applicable standards and applying non-destructive testing methods”. cancel”.

The applicable standards announced by you will then be used to make declaration of conformity and self-assess the conformity with national technical regulations and standards applied when inspecting imported steel quality.

I. STANDARDS OF USE FOR ANNOUNCEMENT APPLICATION:

For steels classified according to HS codes specified in Appendix II of Circular 58, standards for announcement applicable to imported steel are as follows:
In case a basic standard is used for publication of application, that basic standard must have technical requirements not lower than the technical requirements specified in the corresponding national standard of Vietnam.
If there is no national standard of Vietnam, that basic standard must have technical requirements not lower than the technical requirements specified in international standards.
In case there is no national standard of Vietnam or the exporting country or no international standard is available, the requirements for using the corresponding national standard of Vietnam or the exporting country must be satisfied for publication.
(Prescribed in Clause 4, Article 3 of Circular 58)

ORDER FOR PUBLICATION OF STANDARDS

The order and procedures for announcing standards applicable to imported steel are made according to the regulations on announcement of basic standards (TCCS) in Circular No. 21/2007/TT-BKHCN as follows:

Step 1: Make a plan to build TCCS;
Step 2: Compiling the draft TCCS;
Step 3: Organize consultation for the draft TCCS;
Step 4: Organize a symposium on the draft TCCS;
Step 5: Process comments and finalize the draft TCCS;
Step 6: Prepare a dossier of the draft TCCS;
Step 7: Verification of the draft TCCS;
Step 8: Announcement of TCCS;
Step 9: Print TCCS.
For steels classified according to HS codes specified in Appendix III of Circular 58: use the respective national standards of Vietnam or the exporting country for publication.

DISCLOSURE STANDARDS MUST INCLUDE BASIC STANDARDS OF STEEL PRODUCTS AS FOLLOWING:

A) SIZE, APPEARANCE AND MECHANICAL INDICATORS

Geometric dimensions: diameter/thickness, width; length;
Appearance: surface, laminating edge;
Mechanical indicator:
+ Flow limit; tensile strength; relative elongation; or
+ Flow limit; tensile strength; relative elongation; flexural strength limit; or
+ Flow limit; tensile strength; hardness limit; flexural strength limit.
For coated/plated/coated products: additional declaration of coating/plating/coated thickness and adhesion.

B) DIGITALIZATION INDICATIONS

All steel products must declare the content of 05 chemical elements C, Si, Mn, P, S;
For stainless steel products (rust) must announce the additional content of 02 chemical elements Cr, Ni;
For alloy steel products, the content of at least 01 alloying element must be additionally announced (according to the type of alloy steel registered by the organization or individual).
When goods arrive at the port or airport, they shall report to the inspection agency to take samples for inspection. Sampling for quality control can be sampled at the port or at the importer’s warehouse.

The testing time depends on the testing organization’s laboratory, it usually takes from 5 to 7 days to get the test results.

The certificate of conformity is valid for 3 years (for modes 1 and 5) or for each batch of products (for modes 7).

PROCEDURES FOR ANNOUNCEMENT OF CONFORMITY OF IMPORTED STEEL

Steel products are on the list of group 2 goods under the management of the Ministry of Science and Technology. Therefore, after announcing the applicable standard, you need to declare the conformity for your steel products based on the national technical regulations and the applicable published standards.

Declaration of conformity is a mandatory condition for registration for state quality inspection of imported steel products.

Announcement of conformity of imported steel products based on self-assessment results of importing enterprises or through assessment results of registered assessment organizations.

DOCUMENTS FOR PUBLIC DISCLOSURE INCLUDES:

a) Announcement of regulation conformity (according to Form 2 specified in Appendix III of Circular No. 28/2012/TT-BKHCN and additional contents specified in Clauses, 7 Article 1, Circular 02/2017/TT-BKHCN) );
b) The self-assessment report includes the following information:

Time for announcing steel regulation conformity: From 10 to 30 days.

Self-assessment report based on the results of self-implementation of enterprises at a registered laboratory or based on the assessment results of a conformity assessment organization

CHECKING THE QUALITY OF IMPORTED STEEL

Submit the results of self-assessment as prescribed to the inspection agency (General Department of Quality Measurement) within 15 days from the date of customs clearance of goods.

QUALITY TEST SELF-ASSESSMENT RESULTS INCLUDE THE FOLLOWING INFORMATION:

TRADE INSPECTION

In commercial activities, steel, from the time it is produced to the time it is delivered to the buyer and consumer, has to go through many stages (transportation, delivery, preservation, etc.), which cannot be avoided. omissions, losses, etc., leading to disputes between the parties involved in the sale and purchase contract.

Some common disputes are:

Errors in quantity, volume, quality, packaging, value of goods, origin, type of goods, condition, safety, hygiene standards, and other content as required of cutomer. (inspection under commercial contract)
Loss and causes leading to loss, division of responsibility, compensation level of related parties when goods are lost; (insurance loss assessment)
Time, place of delivery, transfer of ownership, risks to the goods … To directly prevent and have a legal basis to resolve disputes that occur quickly when goods are damaged or missing. , loss, damage, etc., the contracting parties often include in the commercial contract a clause to designate an independent, neutral, competent and reputable inspection organization to conduct the inspection and issue the results of the inspection. conformity in terms of goods quality, quantity and volume compared with the signed contract.

LABELING GOODS WITH IMPORTED STEEL ITEM

Labels of stainless steel shall be clearly marked, legible, indelible by hand, inscribed/affixed/tied on bundles, coils, plates, bars and shall meet the following minimum requirements:

– Goods name.

– Name and address of the organization or individual responsible for the goods (manufacturing establishment/importing organization/individual).

– Origin of goods.

– Quantification (volume/quantity).

– Nominal size, steel grade, applicable published standards.

Legal grounds:

The labeling of goods shall comply with the provisions of Decree No. 89/2006/ND-CP dated August 30, 2006 of the Government on goods labels;

Circular No. 09/2007/TT-BKHCN dated April 6, 2007 of the Ministry of Science and Technology guiding the implementation of a number of articles of Decree No. 89/2006/ND-CP and Circular No. 14/2007/TT -BKHCN dated July 25, 2007 of the Minister of Science and Technology on the supplement of Circular No. 09/2007/TT-BKHCN.
